Terms of Use (EULA)

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Bavii Team ("we," "us," or "our"), concerning your access to and use of the "Bavii" mobile application (the "App").

By accessing the App, you confirm that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, you are expressly prohibited from using the App and must discontinue use immediately.

2. Age Restriction

The App is intended for users who are at least 17 years old. By using the App, you represent and warrant that you are at least 17 years of age.

3. App Functionality & AI Services

Bavii provides photography analysis using Artificial Intelligence.

• You understand that AI analysis is probabilistic and may not always be 100% accurate.
• Detailed insights on lighting, composition, and exposure are provided for informational/educational purposes only.

4. User Accounts

To access certain features, you may be required to register with a name, username, and email. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account and password.

5. Intellectual Property Rights

Unless otherwise indicated, the App is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the App (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us.

You are granted a limited license to access and use the App for your personal, non-commercial use.

6. User Conduct & Prohibited Activities

You may not access or use the App for any purpose other than that for which we make the App available. Prohibited activities include, but are not limited to:

• Systematically retrieving data or other content from the App to create or compile a database or directory without written permission from us.
• Making any unauthorized use of the App, including collecting usernames and/or email addresses of users.
• Using the App to harass, abuse, or harm another person.
• Using the App to generate content that is illegal, offensive, or violates the rights of others.
• Attempting to bypass any measures of the App designed to prevent or restrict access to the App.

We care about data privacy and security. Please review our Privacy Policy. By using the App, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE APP.

10. Governing Law

These Terms shall be governed by and defined following the laws of the primary operating location of Bavii Team, without regard to its conflict of law principles.

11. Dispute Resolution & Binding Arbitration

ANY DISPUTE, CONTROVERSY, OR CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, INCLUDING THE FORMATION, INTERPRETATION, BREACH, OR TERMINATION THEREOF, INCLUDING WHETHER THE CLAIMS ASSERTED ARE ARBITRABLE, WILL BE REFERRED TO AND FINALLY DETERMINED BY BINDING ARBITRATION.

• The arbitration shall be binding.
• You waive your right to participate in a class action lawsuit or class-wide arbitration.

12. Corrections and Right to Delete

You have the right to request access to, correction of, or deletion of your personal data. We will respond to such requests sent to our contact email within 5 business days.
